⚠️ Repeat Infringer Policy
StarNestSocial maintains a strict repeat infringer policy. Users who receive three (3) valid DMCA takedown notices will have their accounts permanently terminated. This policy is enforced automatically and applies to all users without exception.
Notice Requirements
Takedown Notice Requirements
Per 17 U.S.C. § 512(c)(3)
- ✓ Physical or electronic signature of copyright owner
- ✓ Identification of the copyrighted work claimed to be infringed
- ✓ Identification of the infringing material with sufficient detail to locate it
- ✓ Contact information (address, phone, email)
- ✓ Good faith belief statement
- ✓ Statement of accuracy under penalty of perjury
Counter-Notice Requirements
Per 17 U.S.C. § 512(g)(3)
- ✓ Physical or electronic signature
- ✓ Identification of the removed material and its former location
- ✓ Statement under penalty of perjury of good faith belief
- ✓ Your name, address, and phone number
- ✓ Consent to jurisdiction of Federal Court
- ✓ Agreement to accept service of process
The DMCA Process
Notice Received
We receive your DMCA takedown notice and verify it contains all required elements.
Content Removed
If the notice is valid, we promptly remove or disable access to the allegedly infringing material.
User Notified
We notify the user who posted the content and provide them with information about filing a counter-notice.
Counter-Notice Window
The user may file a counter-notice if they believe the takedown was improper. If no counter-notice is received within 10-14 business days, the removal remains permanent.
Resolution
If a valid counter-notice is filed, we notify the original complainant. If they don't file a court action within 10-14 business days, the content may be restored.
